Frequently Asked Questions

What is the Statute of Limitations on a California Personal Injury claim?

Generally speaking, the statute of limitations for a personal injury case is 2 years from the date of the incident. However, there are exceptions to the statute and there are rules that govern different types of injuries. For instance, if we are talking about a medical malpractice case, the statute of limitations is 1 year from the incident or from the date that the injured party new or reasonably should have known that they were injured as a result of medical negligence. Make sure to consult with an experienced attorney if you have been inured as a result of someone else’ negligence.

What happens if the other driver doesn’t have car insurance or enough car insurance to cover my injuries or the damage to my vehicle and personal property?

At Khalil Law Group, we always advise our family, friends and clients to make sure to obtain underinsured/uninsured car insurance coverage. This type of coverage on your policy will help to insulate you from the situation that this question brings to light. Call Khalil Law Group any time with questions on this type of insurance coverage.

Can I be found to be at fault for injuring myself at work?

The short answer is; NO. California Workers Compensation claims fall under the “no fault” system. Meaning, that fault is not really at issue. All that matters is whether or not you were on the job at the time of your injury. As with so many other aspects of the law there are exceptions to this general rule. For example, an employer and their worker’s compensation provider can assert the defense of “horse play” if it is found that your injuries were a result of you goofing off on the job. Ask Khalil Law Group for a FREE consultation and case evaluation.

Can I bring a claim for stress against my employer?

Yes, you can. The California Workers Compensation system provides for individuals that have suffered what is known as a “psychological impairment.” This means that you can absolutely bring a claim if your work has caused you psychological strain in the form of stress, anxiety, depression, fear, sleeplessness, etc. You should keep in mind that the threshold for meeting the burden of causation for these types of cases is much greater than for physical injures that are more easily assessed and quantified. Ask the attorneys at Khalil Law Group whether or not your situation is a valid Psychological impairment claim.

Attorneys are expensive! How much is this going to cost me?

AT Khalil Law Group, we totally get this sentiment and we have worked so hard to try to end the “sleazy attorney” stigma. Luckily, Khalil Law group works on a contingency basis for personal injury, worker’s compensation and medical malpractice cases. That means, we only get paid if you win!

What Information do you need from me in order to get started?

This is perhaps the most asked question. When you call our office, the attorneys and case experts will conduct a FREE, no strings attached, analysis of your claim. At that time, we will ask several questions pertaining to your situation and give you our honest opinion as to whether or not your case is valid. Thereafter, you will receive a packet to fill out and return to our office at your leisure. Please keep in mind that the more information you provide, the more prepared the Khalil Law team can be to advocate on your behalf.
